This course is designed to discuss a few selected property law topics in comparative perspective. It will trace the development of these topics from Roman law and show how Roman law concepts and institutions have been accepted in contemporary property law systems. It will examine how familiar Roman law concepts have been interpreted and adapted to serve modern property goals. It will include references to civil law, common law and mixed legal systems like the South African and Scots legal system that are systems that combine civil and common law. Students will be expected to trace the development of the concepts dealt with in Chinese property law as codified in the new Chinese Property Code (Real rights Law) of 2007 and the Interpretation of the provisions of the Code by the Judicial Committee of the Supreme People’s Court, adopted at a meeting on March 23, 2009.
